Electronic time tracking system becomes mandatory when new EU requirement comes into force.
19. January 2024As of July 1, 2024, there will be an EU requirement that all companies must have an electronic time recording system where it must be possible to record daily working hours.
This is done to ensure compliance with the applicable rest time regulations and to ensure compliance with the rules on maximum weekly working hours.
What else does the time tracking system need to do?
The system must also be objective, reliable and accessible. In addition, you must be able to record the time of day the work is done. This information must also be stored for 5 years.
The rules don't apply to everyone
The following are exempt from the rules:
- Self-organizers, which are defined as employees who decide when and how work is to be done (these must have a new contract stating that the employee is a self-organizer)
- Employees who will often be executives themselves, with significant decision-making powers.
- Employees who have a significant degree of freedom and autonomy in the performance of their work.
Working time registration policy
Your company's working time recording policy should be clear, concise and comprehensive. It should also inform employees about what is and isn't working time, as well as what needs to be recorded, when and how.
It is the employer's duty to monitor and control the time registration to ensure compliance with the rules, that the data is correct and that the employee is not at risk of exceeding weekly and daily rest periods. The employer must also be able to document that the necessary measures have been taken to ensure that employees comply with the rules in the Working Hours Act and the Working Environment Act.
Fines for overruns
The cost of not complying with the 48-hour maximum working time rule is between DKK 25,000 and 50,000. That's why a digital time tracking system, which we at HRM Nordic are currently developing, is money well spent.
